2. Client Responsibilities
By working with us, you agree to:
- Provide accurate project information
- Share necessary credentials when required
- Respond in a reasonable timeframe to avoid project delays
- Approve designs, content, and stages for us to move forward
- Make payments as agreed in the proposal or contract
3. Payments & Refunds
Payment terms depend on your selected package or custom proposal.
Typically:
- A deposit may be required before work begins
- Remaining balance is paid on milestones or project completion
- Once design, development, or digital work has started, payments are generally non-refundable
Refunds may be considered only if no work has been delivered.
4. Intellectual Property
- Designs, code, and assets created by Octopace remain our property until full payment is received.
- After full payment, ownership of the final deliverables is transferred to the client.
- Portfolio use: We may showcase completed work in our portfolio unless you request otherwise in writing.
5. Project Timelines
We aim to deliver according to agreed timelines, but delays may occur if:
- Client feedback is late
- Requirements change mid-project
- Third-party platforms (Shopify, WordPress, servers) cause delays
We will communicate all timeline adjustments.
6. Use of Third-Party Tools
We may integrate or use tools such as:
- Shopify apps
- WordPress plugins
- Hosting providers
- Analytics tools
- Email marketing tools
We are not responsible for issues caused by third-party services.
7. Limitation of Liability
Octopace is not liable for:
- Loss of revenue
- Website downtime caused by hosting or third-party tools
- Issues resulting from changes made by the client or other developers
- Security breaches caused by external systems outside our control
Our services are provided on an “as is” basis.
8. Confidentiality
All discussions, project files, and details shared with us are kept confidential.
We can sign an NDA upon request.
9. Termination
Either party may end the project by written notice.
Work completed up to the point of termination must be paid for.
10. Updates to Terms
We may update these Terms from time to time. Continued use of our services means you accept any updated version.
